§1
General provisions; transaction parties; transaction subject

  1. The internet service operating at https://robtivity.pl/ (hereinafter referred to as the Service/Provider).

  3. The Provider provides training services in the field of Robotic Process Automation using UiPath technology.
    Prices for individual services provided by the Provider are determined on each occasion – depending on the duration and complexity level of the training, as well as technological requirements.
  4. The Provider has the right to refuse to perform a service on the Customer’s order, primarily due to inconvenient timing, compensation inadequate to the amount of work, or other factors.
    Before placing an order on the Service, full acceptance of these Terms and Conditions is necessary.
  5. Telephone conversations as well as electronic and paper correspondence conducted in connection with the Service and the Provider’s activities may be recorded and archived. Disclosure of any details arising from these conversations or correspondence is not permitted unless expressly agreed upon by the sender and recipient or when necessary due to a claim pursued by the Provider, particularly against the recipient or sender, or when required by law and at the request of the competent authority.
  6. This regulation has been issued in accordance with the applicable law, in particular:
    the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2017, item 1219);
    the Act of 30 May 2014 on consumer rights (Journal of Laws of 2017, item 683); hereinafter referred to as the Consumer Act;
    the Act of 4 February 1994 on copyright and related rights (Journal of Laws of 2017, item 880).
  7. To use the Service, it is necessary to use a browser: Internet Explorer version 10 and higher, Opera version 12.1 and higher, Firefox version 16 and higher, Google Chrome version 26 and higher, or Safari 6.1 or higher.

§2
Nature of services provided by the Provider

  1. The Provider offers training services in the field of Robotic Process Automation using UiPath technology (hereinafter referred to as Training).
  2. The Provider guarantees the originality of all conducted Trainings.
  3. All consultations and advice with the Provider related to placing and executing orders are free of charge.

§3
Payment

  1. The following payment methods are available on the Service:
    bank transfer,
    cash payment.
  2. Upon the Customer’s request, the Provider may allow payment in installments, in line with the progress in fulfilling the order.
  3. Bank transfer – by transferring money through traditional or online bank transfer. Using this payment method, the Buyer incurs no additional costs. Order processing begins within the time frame agreed upon when the contract is concluded.
  4. The moment of payment is considered to be the moment when the funds are credited to the Provider’s account (in the case of bank transfer) or when the cash payment is received.

§4
Withdrawal from the contract

  1. In accordance with Article 27 in connection with Article 28 point 2) of the Consumer Act, the Customer, who is a consumer, has the right to withdraw from the contract within 14 days from its conclusion.
  2. In the event of exercising the right referred to in the preceding paragraph, the Customer is obliged to inform the Provider by submitting a statement of withdrawal electronically to the address info@robotivity.pl
  3. A statement of withdrawal from the contract submitted after the deadline specified in the first paragraph of this section does not have legal effects. Article 61 of the Civil Code applies directly.
  4. In accordance with Article 38 point 1) of the Consumer Act, the buyer does not have the right to withdraw from a service contract if the Provider has fully performed the service with the explicit consent of the consumer, who was informed before the service began that after its performance by the Provider, the right to withdraw from the contract will be lost.
  5. In a situation where, after concluding the contract, the Customer requested the performance of the service and, within 14 days for withdrawal from the contract, then submitted a withdrawal statement during this period, the Customer shall be obliged to pay the Provider a fee proportional to the degree of completion of the service by the Provider. The amount of payment is calculated proportionally to the scope of the fulfilled service, taking into account the agreed remuneration.
    In the case of submitting a withdrawal statement by the Customer electronically, the Provider shall immediately send confirmation of receipt of the withdrawal statement (in a durable medium within the meaning of Article 2 point 4 of the Consumer Act).
  6. By entering into the contract, the Customer confirms that they have read the content of these Terms and Conditions, including confirming that they have been informed of the right to withdraw from the concluded service contract within 14 days from the date of conclusion of the contract.

§5
Final provisions

  1. Placing an order on the Service is equivalent to consenting to the storage and processing of personal data contained in the order by the Provider, in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).
  2. All matters concerning the protection of customer personal data by the Provider are described in the Privacy Policy.
  3. The Provider reserves the right to change the provisions of these Terms and Conditions.
